Terms of Service

1. About these terms

These Terms of Service ("Terms") are an agreement between you and Jade Intro ("we", "us") and cover your use of jadeintro.com, embedded Jade job pages, and related services (together, the "Service"). By creating an account, posting a job, or applying for a job through Jade Intro, you agree to these Terms. If you use the Service for an organization, you agree on its behalf and confirm you have authority to do so.

Jade Intro helps employers publish job descriptions and collect the first step of an application. Candidates mark the lines of a job description that fit them and excite them, and answer a few short questions by video or text. Jade Intro is not an employer, staffing agency, or applicant tracking system, and we are not a party to any hiring decision or employment relationship.

2. Accounts

• You must be at least 16 years old, and old enough to work or hire where you are, to use the Service.
• Give accurate information, keep your sign-in details secure, and tell us promptly at legal@jadeintro.com if you think your account has been used without permission.
• You're responsible for activity on your account. Team admins are responsible for the people they invite to their team.
• We verify email addresses before you can upload anything, and we may ask for further verification (such as a phone number) to protect the Service.

3. If you apply for a job

• Your marks, notes, answers, videos, profile, and resume are shared with the hiring team for the job you apply to. The employer decides who moves forward, and its own terms and policies apply to how it uses your application.
• You can answer by video or text. Before recording, you'll be told that captions and transcripts are created automatically.
• You can delete any of your videos at any time, including after you apply. Withdrawing an application deletes its videos, answers, marks, and notes. The employer may keep a minimal record (that you applied, to which job, when, the outcome, any withdrawal reason you gave, and its own reviewer notes) for as long as the law requires it to.
• Only apply for yourself, and only share information that is true and that you have the right to share.

4. If you post a job

• You must be authorized to hire for the jobs you post, and every job must be real and currently open. You're responsible for your job descriptions, questions, intro videos, and messages to candidates.
• You're responsible for complying with the laws that apply to your hiring, including equal employment opportunity, anti-discrimination, pay transparency, accessibility, background check, and record-keeping laws, and for any statements those laws require in your postings.
• Use applicant information only to evaluate candidates for the job they applied to and to communicate with them about it. Don't sell it, share it outside your hiring process, or use it to build profiles of people.
• Don't use the Service, or information from it, to score, rank, or analyze candidates with automated tools, including analyzing applicant videos with AI, unless you have met every legal requirement that applies (such as notice, consent, and bias audits).
• Respect applicants' choices. When an applicant deletes a video or withdraws, the content is removed from Jade Intro and from any links we have shared with your other systems. Don't keep your own copies beyond what the law allows.
• You are the controller (or "business") for applicant data you collect through your jobs, and we process it on your behalf, only to provide the Service to you.

5. Your content

You keep ownership of what you put into the Service: job descriptions, videos, answers, notes, resumes, logos, and other material ("Your Content"). You give us a worldwide, non-exclusive, royalty-free license to host, store, process, transcribe, caption, display, and transmit Your Content only as needed to run, secure, and improve the Service and as you direct (for example, showing an application to the hiring team, or showing a public job page in search results). This license ends when Your Content is deleted from the Service, except for copies in backups, which are removed on our normal backup schedule.

You confirm you have the rights to Your Content and that it doesn't violate anyone's rights or the law. We may remove content that breaks these Terms.

Public job pages may show "Powered by Jade Intro" and may be indexed by search engines, including Google for Jobs. Unlisted jobs are available to anyone with the link but are not indexed.

6. How Jade uses AI

We use AI models to organize job descriptions into sections and lines, to read job details from pages you import, and to summarize uploaded resumes. Summaries are labeled as automatically extracted and may contain errors. Jade Intro does not use AI to score, rank, or recommend candidates, or to analyze applicant videos. People on the hiring team make every decision. We don't allow the AI providers we use to train their models on Your Content.

7. Acceptable use

You agree not to:

• post fake, misleading, or discriminatory jobs, or jobs that ask candidates for payment;
• collect government ID numbers, bank details, passwords, or other sensitive information through job questions;
• upload unlawful, harassing, sexually explicit, or infringing content, or malware;
• impersonate anyone or misrepresent your affiliation with an organization;
• scrape, copy, or bulk-download the Service or its data, except through features we provide;
• probe, overload, or get around the Service's security, rate limits, or usage limits; or
• use the Service to break any law.

8. Plans and fees

• Applying for jobs is free.
• Employers can use a free plan with limits shown in the product (for example, the number of open jobs and applications per job). Paid plans are billed per active job per month, or as otherwise shown when you subscribe.
• Paid plans renew automatically until you cancel. You can cancel at any time and your plan stays active until the end of the billing period. Except where the law requires, fees are not refundable.
• Prices exclude taxes, which you're responsible for. Payments are processed by our payment provider, Stripe.
• We'll give you at least 30 days' notice before a price change affects your plan.

9. Other services

The Service relies on other providers, including for video hosting, file storage, email, sign-in, and payments. If you connect Jade Intro to other tools, such as an applicant tracking system, your use of those tools is governed by their own terms, and we are not responsible for them.

10. Ending your use

You can stop using the Service and delete your account at any time. We may suspend or end your access if you break these Terms, if your use creates risk or legal exposure for others or for us, or if we stop offering the Service; where reasonable, we'll tell you first and give you a chance to export your data. Sections 5 (the last paragraph), 11, and 12 continue after your account ends.

11. Disclaimers and liability

The Service is provided "as is" and "as available". To the extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We don't guarantee that any job will be filled, that any applicant will be hired, or that the Service will be uninterrupted or error-free.

To the extent the law allows, Jade Intro will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data. Our total liability for any claim relating to the Service is limited to the greater of the amount you paid us in the 12 months before the claim and US $100.

If you use the Service for an organization, that organization will defend and indemnify Jade Intro against third-party claims arising from its job postings, its hiring decisions, or its breach of these Terms.

12. General terms

• Changes. We may update these Terms. If a change is material, we'll notify you by email or in the product at least 30 days before it takes effect. Continuing to use the Service after that means you accept the new Terms.
• Governing law. These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-law rules. Disputes will be resolved in the state or federal courts located in Delaware, unless the law where you live requires otherwise.
• Whole agreement. These Terms, plus any order form you sign with us, are the whole agreement between you and us about the Service. If any part is unenforceable, the rest still applies. Not enforcing a term is not a waiver of it. You may not transfer these Terms without our consent; we may transfer them as part of a merger or sale of our business.
